Avi J. Lipman

Avi Lipman is a trial attorney at McNaul Ebel, where he represents plaintiffs and defendants in commercial litigation, professional malpractice, insurance, employment, criminal defense, franchise, and business disputes.  Mr. Lipman has tried and arbitrated numerous civil and criminal cases as first-chair counsel in Washington, D.C. and throughout the Pacific Northwest.  

Mr. Lipman previously taught trial advocacy and practiced at the Georgetown University Law Center, where he was an E. Barrett Prettyman Fellow.  Before joining McNaul Ebel in 2008, Mr. Lipman represented clients as a trial attorney at the King County Defender Association.  He earned his J.D., cum laude, from New York University School of Law, where he was a Root Tilden Kern scholar.  He also holds a Master of Laws (LL.M.) in trial advocacy from the Georgetown University Law Center.  Mr. Lipman was named a "Rising Star" by Washington Law & Politics magazine for 2010, 2011 and 2012.  He regularly gives presentations on trial practice and other professional issues.

Representative Cases 
  • Employment Litigation/Appeals.  Represent plaintiff in employment dispute against Fortune 100 employer.  Successfully argued appeal before Division One of the Court of Appeals, which ruled unanimously that plaintiff is not required to litigate her claims in Europe.  A copy of the Court's decision is available here.
  • Commercial Litigation/Constitutional Law/Appeals. Represent plaintiffs in Davis v. Cox, an action for breach of fiduciary duty against corporate directors.  Successfully argued appeal before the Washington State Supreme Court, which ruled unanimously that Washington’s Anti-SLAPP Act (RCW 4.24.525) violates the Washington State Constitution and is therefore invalid.  Video recording of oral argument is available here.  A copy of the Supreme Court’s decision is available here.  
  • Commercial Litigation.  Defense of 50% shareholder of closely held corporation against claim for breach of fiduciary duty.  First chair counsel in jury trial that resulted in complete defense verdict.
  • Financial Services.  Defense of former financial advisor against brokerage firm's claims for breach of contract.  First chair counsel at arbitration before the Financial Industry Regulatory Authority (FINRA) that resulted in award in client's favor on counterclaims.
  • Franchising.  Defense of national franchisor against claims by franchisees alleging violations of Washington's Franchise Investment Protection Act.  First chair counsel in jury trial that resulted in complete defense verdict and award of fees and costs in clients' favor.
  • Professional Malpractice.  Defense of Seattle law firm in action for professional malpractice.  First chair counsel at jury trial that resulted in hung jury in client's favor.  Negotiated favorable settlement to resolve case.
  • Financial Services.  Regularly counsel and successfully defend financial advisors and securities brokers with respect to claims by brokerage firms.  Acted as first chair counsel at numerous arbitrations before the Financial Industry Regulatory Authority (FINRA).
  • Insurance.  Defense of Fortune 100 insurance company in coverage dispute.  Defeated claims in federal court with motion for summary judgment.  Negotiated favorable settlement to resolve appeal.
  • Criminal Defense.  Defense of client charged with first-degree murder in complex case involving DNA and ballistics evidence.  Through extensive litigation and negotiation, persuaded the King County Prosecutor's Office to dismiss the entire case before trial.
